Alphalitigator Launches Counter-Forensics Practice Group

Kansas City, MO -- March 14, 2009  --  Alphalitigator Group LLC announces that it has  established a Counter-Forensics Practice group focused on the analysis of forensic collections to identify potential counter arguments to forensic expert testimony, consultation regarding implementation of secure ESI destruction techniques, and services to securely wipe data and media where required.  Counter-forensics has been defined as “any attempt to compromise the availability or usefulness of evidence in the computer forensics process and encompasses four categories including: evidence destruction, evidence source elimination, evidence hiding, and evidence counterfeiting” (McCullagh, 2005 in Harris, 2006).

"Our top litigator clients in complex litigation are requiring a deeper knowledge of the internal workings of computer systems, networks, and applications to determine facts in their cases,” said Christopher Loman, Principal Consultant of Alphalitigator Group LLC.   “The need for understanding the mechanisms of validation and the defensibility of how data is collected is burgeoning in the litigation technology marketspace.”

Deep knowledge of the internal workings of computer systems, networks, and applications enables our team to support top litigators as they grapple with ESI and ESI Metadata issues in complex heterogeneous computing environments. The Alphalitigator approach begins with gaining a genuine understanding of the critical events in the case and continues through the Identification, Collection, Analysis (including Reconstruction and/or Deconstruction of an event sequence), to the ultimate communication of our conclusions and their relation to facts and theories of the case.

Alphalitigator Introduces Litigation Tech Services for Attorney Access to Arcane Sources of ESI

Kansas City, MO -- May 1, 2009 --  Alphalitigator Group LLC announces the formal release of a service that enables firms and corporations to access legacy and arcane computing systems for online attorney review. “The need for placing legacy, unsupported computer systems online for attorney review will be an ongoing burden for corporations under litigation holds,” said Christopher Loman, Principal Consultant of Alphalitigator Group, LLC.  “As an example - during a recent healthcare litigation - our client required that backup tapes from 1999 be accessed and that relevant data within a legacy application be extracted. Our efforts revealed that the tapes were from a SCO Unix System Version 3 (a version of SCO Unix that is no longer commercially available) and that the relevant data were in an application where the company was no longer in business (PCN). We had no manuals, no passwords, and no outside support – it was 100% up to us.” In order to bring the system on line, Alphalitigator accessed tapes in an unknown format, virtualized an antiquated system, cracked passwords, successfully configured an undocumented application, and provisioned secure remote access to the critical ESI.

Over the internet, attorneys and their experts are able to query and review the data, print reports, and make relevance decisions.

"Our clients often have a legal burden to review ESI from complex computing environments," said Jeffrey Johnson, Chief Market Strategist for Alphalitigator Group LLC. "Our flexible and scalable solutions facilitate this process, and we continue to serve the increasing need for sophisticated, defensible litigation technology solutions."
